We are delighted that you are considering purchasing contact lenses from us. Please read the following terms as these will apply to any contact lens purchase you make from us.

If you do not agree to be bound by our terms, then please do not continue with your purchase.

Please note that words in bold are defined towards the end of these terms in the section titled "Definitions" (please see paragraph 11).

1. Prices

The prices payable for the contact lenses that you order are clearly set out on the relevant part of the website. If, by mistake, we have under-priced an item, we will not be liable to supply that item to you at the stated price, provided that we notify you before we dispatch the item concerned. All prices are expressed inclusive of any VAT payable unless otherwise stated.

2. Contact Lens Specification

By making an order you are confirming that you have a valid in date contact lens specification from your optician for the contact lenses that you are ordering and that the information you enter into the site is true and matches your contact lens specification as provided by your optician. You hereby consent to our contacting your optician, to verify your contact lens specification and any other necessary information. You must comply with all instructions for use from your optician and stated on the product or on any inserted leaflet.

3. Acceptance

Your order is an offer to buy from us. There will be no contract of any kind between you and us unless and until the goods have been dispatched to you at which time a contract will be made between you and us, and you will be charged for the goods. At any point up until then, we may decline to supply the goods to you without giving any reason though we will try to notify you as soon as we can.

4. Delivery

Delivery will be made to the address specified by you on the completed order form. Please note that we can only deliver products within England, Scotland, Wales and Northern Ireland.

We will do our best to secure dispatch within 14 days of the date of your order but we do not guarantee availability of products or dispatch times.

We shall bear the risk of any damage to or theft or loss of products during transport to the delivery address. This risk will pass to you at the moment of the delivery. Upon delivery you should inspect the products to check for damage. If there is any damage, please do not use the products and return them as described in section 8.

5. Liability

Any liability of Andrew Bolton Opticians (whether in contract, tort or otherwise) resulting from the delivery of defective products or late delivery of products will be limited to direct foreseen damages up to the amount of the price paid for the items concerned. Liability for indirect damages or consequential loss is excluded to the extent permitted by law.

In no circumstances will we be liable to you for any loss of profits, contracts, goodwill, or for any business interruption.

5.1 Subject to Clause 6, any delay in the delivery of products will not entitle you to terminate the order unless the delay exceeds 60 days.

5.2 Without prejudice to the provisions set out above, we will not be liable in the event that the damage was caused by any intentional act or omission or gross negligence by you or your improper use of the products delivered to you.

5.3 We shall not be held liable for any information held on websites which may have links to or from the Website and which are not maintained and controlled by us.

6 - Force Majeure

6.1 We nor you will be obliged to fulfill any contractual obligation if either of us is prevented from so doing due to a circumstance outside our respective control including but not limited to postal strikes, electrical failure, transport interruption, etc, ("Force Majeure"). For purposes of any Agreement and in addition to the above definition and any cases implied by law, Force Majeure will be defined as any and all external causes, whether foreseen or unforeseen, which are beyond our control, but as a consequence of which we are unable to fulfill our obligations.

6.2 While a Force Majeure continues to operate, Andrew Bolton Opticians and you may suspend their respective obligations under any Agreement. If this period of suspension lasts over 2 months, either party will be entitled to treat any order accepted by Andrew Bolton Opticians as terminated without further obligation to the other.

6.3 If we  have already fulfilled its obligations under any Agreement in part when the Force Majeure occurs, we will be entitled to charge you for that fulfilled part.

6.4 Once a Force Majeure is operating if you have paid for a product yet to be dispatched to you, we shall return to you the amount paid.

7. Cancellation

You have the right to cancel your order up to 14 working days after the day following the delivery of the goods by contacting us online at info@andrewboltonopticians.co.uk or by phone on 01382 640046. In the event that the goods have already been dispatched at the date of receipt of your cancellation of the order we will credit your credit or debit card with the price of the goods within 30 days beginning with of the date the returned goods are received.

Returns should be made in accordance with the process in section 8 below. If you do not return the goods within 21 days of your cancellation, we will make a charge in respect of the cost of recovering the goods. If you do not return the goods or fail to make them available for collection within 30 days of your notice of cancellation, you will be deemed to have accepted the goods, at which point a new purchase contract will be made and you will be charged for your order at the price set out on the web site. This does not affect your statutory rights.

Between the date of your election to cancel and the date the product is returned by you to us you shall bear all risk in keeping the products safe, secure, and free from loss or damage.

8. Returns

The item(s) must be returned with all components intact within 14 days of receipt.

Once the item has been received by us we will credit your account. If you are returning a product, including a copy of the confirmation email with the package will greatly assist in processing your return and ensure you receive a prompt refund.

8.1

We will issue a full refund or replacement of goods in all instances where:

products are supplied damaged

products ordered by you either within 14 days of the dispatch date do not arrive at the delivery address

products you have ordered are returned to us as undeliverable by the postal service

you exercise your cancellation right. Please see clause 7.

A refund or replacement will be issued to you following receipt by Andrew Bolton Opticians of the returned goods. Such refund or replacement will be provided within 30 days of the date the returned goods are received.

8.2

If goods are returned to us as undeliverable, you will be contacted by email for confirmation of the delivery address. If no reply is received within a reasonable period and in any event within 30 days of the receipt by us of the goods, then a refund will be made within 30 days of that date.

8.3

We may refuse to accept future orders from those who have made previous unsubstantiated claims for non-delivery of goods or for failure to return the goods within the times specified in clause 7.

8.4

Refunds will be limited to the maximum value of the original order, including delivery charges and will only be issued against the same payment details as supplied to pay for the goods. We reserve the right to proportionately reduce the level of the refund if only some of the original quantity of products is returned, or if it is clear that some of the products have been used. In the case of goods returned under your cancellation right, these must be returned undamaged, unused and unopened to qualify for a refund.

8.4

Nothing within these Terms and Conditions of Purchase affect your statutory rights.

9. Payment

Payment is managed by PayPal.

10. General

These Product Terms are subject to Scottish law. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so within the United Kingdom.

You are responsible for the security and proper use of your password and must take all reasonable steps to ensure that the password is kept confidential.

You know of no reason why the contact lenses which you are ordering would not be appropriate for you.

You are not experiencing any discomfort with the contact lenses you are currently prescribed to wear.

The order placed through this Website represents a request for contact lenses by you, which fulfills the needs of you yourself and no other person.

You are aged 18 years or over

11. Definitions

When used in these terms the words set out below shall have the following meanings:

a. purchase means any order you make which is accepted by us

b. cancellation means if you cancel any purchase for any reason or if we cancel any purchase where we are entitled to so under these terms

c. these terms means these terms and conditions together with the terms of use for our website, our privacy policy, any specific terms in relation to a particular package which we may publish on our website.

d. website means the site located at www.andrewboltonopticians.co.uk or any subsequent address(es) which may replace it

e. we/us/our means Andrew Bolton Opticians

f. you/your means the person who makes the purchase
